Arizona Laws

If you are going through a divorce in Arizona, it is mandatory that both parties attend a court mandated co-parenting class. If one party doesn't fulfill this requirement, he or she may not be able to obtain custody or time with the child. The parents cannot attend the same class. A.R.S. ยง 25-351 In order to file for dissolution, at least one of the parties must be a resident of the state for at least 90 days prior to the filing. As of January 1, 2013, Arizona changed its child custody laws. The word "custody" is now completely removed from the statutes so instead the court awards "legal decision-making" and "parenting time." The judge has the ability to make the decision-making equal or even give one parent the entire authority. A major change in the law is that while in the past judges looked at who historically provided the primary care for the child, now they are to look at the bigger picture including the "past, present and potential future relationship between the parent and child."

Arizona Parenting Plans

Arizona law requires that both parents agree to a parenting plan. This includes how decisions on education, health and religion will be made. Also, a residential plan that specifies a schedule of physical and visitation custody. They also must agree on a way to resolve future disputes either through a mediator, counselor, or clergy member before going back to court.
