Utah Divorce Laws

According to a 2009 Census Bureau study, Utah had a slightly higher divorce rate than the national average of 3.4. The population generally marries about 2 years younger than the rest of the country and many analysts agree that this has an impact on the divorce rate. To get divorced in Utah, you or your spouse must have lived in the state for at least 3 months prior to filing the petition. If a child is involved, generally the child must have resided within the state with one of the parents for the 6 months prior to the filing. If there are no hitches, Utah law requires that there is a minimum of 90 days between the date the petition is filed and the date of the final divorce decree. Utah is both a "fault" and "no fault" state. There are 2 grounds for no-fault which include irreconcilable differences and living apart for at least 3 years. If you think there is fault, you must prove adultery, willful neglect, habitual drunkenness, desertion for more than 1 year, extreme cruelty, incurable insanity or inability to perform sexually.

Utah Parent Education Classes

Residents going through divorce in Utah must take a mandatory divorce education class as specified by the court. This includes an orientation class that must be taken in person and then a group or online education course. This class is meant to help parents understand and empathize with their child's reaction to the divorce. Students learn effective communication skills, improving the child's self-esteem, appropriate role modeling and conflict management and how to share co-parenting responsibilities.
