Rhode Island Divorce Laws

If you are seeking a divorce in Rhode Island don't expect anything to happen too quickly. Rhode Island has the 2nd longest waiting period for divorce in the country, with a divorce rate of about 9.5%. You must have lived in the state for the year prior to filing. If the divorce is uncontested, the hearing can be scheduled after 60 days. Then there is about a 5-month "cool down" period before the Family Judge will sign the final judgment. If the divorce is contested, it generally takes between 6 - 10 months. Rhode Island is both a fault and no-fault state, or based on separation from your spouse for 3 years. Adultery is a criminal offense in Rhode Island and is still taken extremely seriously. The offender can be fined $500 and if the adultery caused the breakup, the judge can determine that the cheating spouse doesn't get any alimony.

Rhode Island Parent Education Classes

If you are going through a divorce with children under the age of 18, the Family Court Judge might mandate a co-parenting class for the best interest of the children. These programs are designed to help parents develop empathy for what the child is going through, how to effectively communicate, how to set up parenting plans and to co-parent in two separate households.
