Tennessee Divorce Laws

Tennessee has 2 types of divorce - uncontested and contested. The first is based on "no fault" or irreconcilable differences. In a divorce based on "fault", the parties generally can't agree and must go to trial. Grounds that must be proved include: adultery; alcoholism or drug abuse; living apart for 2 years with no minor children; inappropriate marital conduct; willful desertion for 1 year without a reasonable cause; refusal to move to Tennessee with your spouse and living apart for 2 years; malicious attempt upon another life; impotency or sterility; bigamy; abandonment; and lack of reconciliation for 2 years after a formal separation. A divorce can only be granted if one of the spouses has lived in the state for 6 months prior to filing. There is no waiting period to file for a divorce but you can't remarry until 30 days after the final hearing.

Tennessee Parent Education Class

Tennessee requires all divorcing parents to take a divorce education class that teaches how to minimize the negative effects on your family. They are meant to help with skills in communication, behavior and stress management. Different counties require different length classes. For example, in Chancery Court the minimum is 4 hours while in others it can be up to 12 hours. Parents must take this class before a parenting plan will be approved.
