Divorce Rate In Alabama

According to the Census Bureau, as of 2011 Alabama had the 2nd highest divorce rate in the country. Some research also noted that Alabama has a higher rate of marriage then the rest of the country and that many marry at a younger age than in other states.

Family Court Laws

The state requires that at least one of the parents has been a resident of the state for the prior 6 months before filing. Alabama generally awards custody to both parents and encourages them to share the responsibilities in raising the child. Statute 30-3-150 clearly defines the guidelines: "It is the policy of this state to assure that minor children have frequent and continuing contact with parents who have shown the ability to act in the best interest of their children and to encourage parents to share in the rights and responsibilities of rearing their children after the parents have separated or dissolved their marriage. Joint custody does not necessarily mean equal physical custody."

Co-parenting as a team is essential for the best interest of the child. Our classes teach the skills necessary to resolve disputes, effectively communicate and make a daily, weekly even yearly plan. Alabama statute 30-3-153, Plan By Parents, states that in order to implement joint custody, the court requires the parents to submit provisions covering such topics as:

  1. Child support.
  2. Care and education.
  3. Medical and dental attention.
  4. Holidays and vacations.
  5. Other necessary factors like religion, cultural, and athletic activities.

If the parents can't come to an agreement on these factors, the court will set the plan.
