Virginia Divorce Laws

While the divorce rate in America hit a high in the 1980's of around 50%, it has been coming down. Virginia's divorce rate is at around 10%, making it one of the lowest in the country. This might be because it isn't easy to get a divorce in this state. To start with, the spouse that files for divorce must have been a resident of the state for the prior 6 months. Virginia is both a "fault" and "no fault" state. If there is "no fault" then both spouses must live apart for 6 months with a written agreement and have no children or 1 year with children. A "fault" divorce would be based on grounds such as adultery, felony conviction after the date of marriage, cruelty, willful desertion or abandonment. The entire filing process can be very slow and take over a year, which is among the longest in the country.
