Hawaii Divorce Laws

The state of Hawaii will not grant a divorce unless one of the parties of the marriage has been living in the state for at least 6 months prior to filing for divorce and one spouse must have been resident of the county where the divorce is being filed for at least 3 months. Hawaii is a not fault state which means that you can get divorced even if your spouse doesn’t agree that your marriage can’t be fixed. You don't have to state a particular reason for getting divorced.

Mandatory Parenting Classes

All parents going through a divorce with children between the ages of 6 and 18 have to attend a state mandated in-person parenting class. However, there are a few exemptions from this particular program. You can request that your judge allow an online class if you are moving out of state or are deploying for the military, are incarcerated or reside in a residential facility or currently live in another state.
