Divorce Laws in Idaho

Surprisingly, some reports show that Idaho ranks as high as 5th in the nation for the divorce rate. Some attribute this to the high number of marriages at a younger age than the rest of the country. To file for a divorce in Idaho, the filer must have lived in the state for at least 6 weeks prior to beginning the proceeding. After this there is a 20 day cooling off period until any action can be taken by the court. If children are involved, the court will consider the parent's wishes for custody as well as the child's. If the children are living with a grandparent in a comfortable and stable situation, then the court will recognize the grandparent at the same level as the parents for custody rights.

Parent Education Classes

Years of research shows that divorce is definitely stressful on children and their parents. Children of divorce are at a higher risk for low self-esteem, doing poorly in school, depression and acting out. The courts understand that there are certain things that parents can and should do to help their kids cope with the change. Therefore, Idaho courts have made it mandatory for all parents presenting child custody issues to the judge to attend parent education classes to help them learn how to effectively communicate with one another as well as with their children. Classes also teach how to create a parenting plan and how to most successfully set up two separate households that work together in the best interest of the kids.
