Indiana Divorce Laws

A shocking census bureau estimate in 2008 showed that Indiana had 3 counties that were in the top 10 in the country for highest divorce rates. Specifically, Wayne County had a 19% divorce rate compared to a national average of 10.7% at the time. Floyd and Madison counties were also on the list. No one is sure exactly why, but the high unemployment rate surely played a factor. Maybe it is because it's a fairly easy process to achieve. To start divorce proceedings in Indiana, one or both spouses must have been a resident in the state for the 6 months prior to filing, pay a $157.00 fee to the state and generally wait about 240 days for the entire process. It is a "no fault" divorce state which means that neither of you have to prove that anyone did anything specifically wrong to get a divorce.

Divorce Laws Pertaining To Children

If children are involved, the court will decide custody based on the best interests of the child. The court takes into consideration the age and sex of the child, the parents wishes, the child's wishes, the child's relationships with parents, siblings, grandparents and others, the child's adjustment and stability at home, school and the surrounding community, any evidence of domestic abuse, and the mental status of everyone involved. At age 14, the child's wishes about custody are considered by the court. When parents file for divorce in Indiana, the court generally requires them to complete a 4 hour parent education course that covers anger, stress and conflict management, the emotional effects to children, how to develop a responsible and stable co-parenting relationship and how to make a parenting plan.
