Iowa Divorce Laws

It isn't difficult to get a divorce in Iowa. It's a no-fault state so all you have to say is that the marriage has failed and can't be fixed. You are your spouse must have lived in Iowa for one year before you can file, then you have to wait 90 days and the court can grant your divorce unless you have issues that need to be worked out. It costs about $300.00 total in court fees without any legal fees you incur with an attorney. The ease of this process may have contributed to Iowa's high rate of divorce which spiked in 1981 at a rate of 4.2 Iowans per 1,000. More recently, Iowa is finally experiencing a slowdown in the divorce rate which has now slipped to 2.2 per 1,000 residents.

Iowa Code ยง 598.15 mandates that parents seeking a divorce involving children under 18 must participate in a court-approved parenting course. The class should be designed to sensitize and bring awareness to the impact this is having on the children. Caregivers should learn how to best assist their children with the changes and to improve relationships within the family. Parents interested in fulfilling this requirement online should get prior approval from their judge, social worker or through their attorney.
