Divorce in Mississippi

As of the 2009 Census Bureau report, Mississippi had the 6th highest divorce rate for women and the 11th highest for men in the United States. However, it's not easy to get divorced here and is an event that can be very difficult for everyone involved to get through. Mississippi legally refers to a termination of marriage as a "Divorce From the Bonds of Matrimony". In order to file for divorce in this state, one of the parties has to have been a resident for at least 6 months preceding the filing. The Mississippi Chancery Court has total jurisdiction over divorces and can be found in each of the 82 counties. It is both a Fault and No-Fault state, so a divorce can be based on Irreconcilable Differences. Based on Mississippi Code, Title 93, Section 93-5-24, if the parents can't come to an agreeable parenting plan, the Mississippi family court will step in and award custody based on the child's best interest. Parenting classes are not always mandatory but can be assigned by the Chancery Court. Taking a parenting class proactively as a good faith measure can show the court you are serious about doing what is best for your child.
