Information On Divorce In Missouri

If you are interested in filing for divorce in Missouri, you or your spouse must have been a resident for at least 90 days prior. The marriage can be dissolved on the grounds that it is irretrievably broken. If one party denies this to be the truth, the other party must prove adultery, abandonment, intolerable behavior, or that you have lived apart for at least 1 year by mutual consent. Once filed, the divorce pends for a minimum of 30 days for a cooling off period before the divorce can be granted. When children are involved, Missouri law requires that parents submit a mutually agreed upon parenting plan. If you can't agree on one, the judge will develop one for you. Missouri courts under Section 452.372.1 require parents of minor children who are separating or getting a divorce to participate in a parent education class. This is generally taken in the first 45 days after filing and is meant to help you understand the impact on the children, how to co-parent effectively and how to lower the tension and stress on the kids. These classes are also designed to instruct parents on how to set up a parenting plan.
