North Carolina Divorce Laws

North Carolina is a no-fault state. In order to file for a divorce, you or your spouse must have lived in the state for the 6 months preceding the filing. North Carolina has instituted the method of a "collaborative divorce" which many couples find easier and better for the children in the long run. Utilizing this strategy, divorcing parents negotiate a resolution with the assistance of specialized attorneys, neutral party financial specialists and/or divorce coaches. All information is put clearly on the table. Once the collaborative divorce process begins, lawyers involved can't represent the parties in a contested legal proceeding if the process doesn't work out.

Session Law 1999-237 House Bill 168 Section 17.16

Parents going through a divorce can be asked to take a parent education program designed to develop empathy for their children during and after the separation. This 4 hour program helps caregivers to learn about the legal process and learn how to work as a team for the child's best interest. Parents interested in taking this program online rather than in-person should get prior approval from their judge, probation officer or through their attorney.
