South Carolina Divorce Laws

To file for a divorce in South Carolina, both spouses must have lived in the state for the past 3 months, or if one has moved away, the other spouse must have lived in the state for the prior year. There is one "no fault" ground which is called "Living Separate and Apart for One Year Without Cohabitation." Otherwise there are 4 grounds based on "fault" which include desertion, adultery, physical cruelty or habitual drunkenness and/or drug abuse. If you are filing based on "no fault" grounds, you can't file for divorce until you've lived apart for 365 days. If it's based on "fault" then you can request a final trial hearing 90 days after you file.

South Carolina Parent Education Classes

Parenting or co-parenting classes can be mandated by the judge at his/her discretion. If your judge stipulates divorce education classes, you can request that you be allowed to take them online. Many parents find themselves too busy to get to weekly classes, or there aren't any nearby, or they are too expensive, or they don't have a reliable babysitter to watch the kids while they are at class. There are many valid reasons to get approval to learn new skills in the convenience of your own home, online.
